Position Overview
We are seeking an experienced and motivated Advocate to join our legal team in the Real Estate sector. The ideal candidate will have expertise in real estate laws, property transactions, contract law, land acquisition, and dispute resolution. This role involves providing legal support in real estate development, transaction documentation, due diligence, and advising on legal matters related to property deals, leases, and regulatory compliance.
Key Responsibilities
- Legal Advisory in Real Estate Transactions: Provide legal advice and guidance on various real estate matters, including property sales, purchases, leasing, and land acquisition.
- Drafting and Reviewing Contracts: Draft, review, and negotiate legal documents, such as sale deeds, lease agreements, joint venture contracts, and development agreements.
- Regulatory Compliance: Ensure that all real estate transactions comply with applicable laws and regulations, including RERA (Real Estate Regulatory Authority), stamp duty laws, and local land laws.
- Due Diligence: Conduct thorough due diligence on properties, including title verification, land use regulations, zoning issues, and any encumbrances or legal disputes.
- Litigation and Dispute Resolution: Represent the company in legal disputes related to real estate matters, including property title disputes, evictions, encumbrance disputes, and other property-related litigation.
- Land Acquisition and Development: Advise on and facilitate legal aspects of land acquisition for development projects, including land title verification, clearance requirements, and land-use permissions.
- Risk Management: Identify legal risks related to real estate transactions and recommend mitigation strategies to senior management.
- Documentation and Record Keeping: Maintain a comprehensive database of contracts, deeds, and legal documents, ensuring all records are up-to-date and easily accessible.
- Legal Research: Stay up-to-date with the latest developments in real estate laws, policies, and regulations. Provide recommendations to the management based on legal research and case studies.
- Coordination with External Counsel: Liaise with external legal firms or consultants for specialized legal support, and ensure alignment with internal legal strategies and goals.
- Client and Stakeholder Interaction: Communicate effectively with clients, government authorities, vendors, and stakeholders on legal matters related to real estate transactions.
Qualifications
- Education: A Bachelor’s degree in Law (LLB) from a recognized university. A post-graduate degree in law (LLM) or a specialization in real estate law is a plus.
- Experience: Minimum 0.5 - 1 years of experience as a practicing advocate, with a strong focus on real estate law and property transactions.
- Licensing: Must be a practicing advocate with a valid registration from the Bar Council.
- Skills:
- In-depth knowledge of real estate laws, RERA regulations, and property transaction processes.
- Strong drafting, negotiation, and documentation skills for real estate agreements.
- Ability to handle complex property disputes and litigation.
- Familiarity with land acquisition laws, title verification, and zoning regulations.
- Proficiency in using legal software and document management systems.
- Strong communication and presentation skills.
- Ability to manage multiple projects and deadlines in a fast-paced environment.
Preferred Skills
- Experience in dispute resolution and arbitration related to real estate issues.
- Knowledge of taxation laws related to real estate (stamp duty, capital gains tax, etc.).
- Experience in real estate development projects and construction contracts.
Working Conditions
- Employment Type: Full-time
- Working Hours: 9:30 AM to 6:00 PM, Monday to Friday (with flexibility as required by project timelines)
